“I have lost in or been denied hearing by the highest appellate level court in my state. Can I seek Certiorari to the United States Supreme Court?”

In every case where a party has lost in the highest court in his or her state or been denied discretionary review in that court, he/she/it has ninety (90) days to seek a Writ of Certiorari to the United States Supreme Court located in Washington, D.C. This Court has very elaborate rules that must be strictly followed in order to perfect an appeal. Unless the case has presented a serious constitutional issue, it is very unlikely Certiorari will be granted. Nevertheless, while it is the highest court in the Nation, every citizen has the right to seek Certiorari.
